Cieco Eyewear – operated by Beyond The Brand

These Terms and Conditions (“Terms”) apply to purchases made through the Cieco Eyewear website and webshop.

By placing an order with Cieco Eyewear, you agree to these Terms. If you are a consumer, nothing in these Terms limits or excludes any mandatory rights you may have under the laws applicable in your country, state, or place of residence.

In these Terms, “Cieco Eyewear”, “we”, “us”, and “our” refer to Beyond The Brand trading as Cieco Eyewear.


2. Applicability

These Terms apply to all offers, orders, purchases, and agreements made through the Cieco Eyewear webshop, unless otherwise agreed in writing.

By placing an order, the customer confirms that they have had the opportunity to review and accept these Terms.

Mandatory consumer protection laws applicable to the customer always take precedence over any conflicting provision in these Terms.


3. Products and Product Information

We make reasonable efforts to display and describe our products as accurately as possible.

Because colors and product appearance may vary depending on screens, displays, lighting, and photography, minor differences between product images and the actual product do not necessarily constitute a defect.

Product measurements and specifications may be subject to minor manufacturing tolerances where reasonable for the type of product concerned.

We reserve the right to correct obvious errors or omissions in product descriptions, specifications, availability, or pricing.

Such corrections do not affect any mandatory rights that consumers may have under applicable law.


4. Prices, Taxes and Duties

Prices are displayed in the currency indicated on the website or during checkout.

For customers in the European Union, prices include VAT where required by applicable law, unless clearly stated otherwise.

For customers outside the European Union, including customers in the United States, applicable sales taxes, import duties, customs charges, or similar government charges may apply.

Where possible, applicable taxes and charges will be displayed during checkout. Where duties, taxes, or customs charges are not collected by us, they may be charged separately by the relevant authorities or delivery provider, where permitted by applicable law.

Shipping costs, where applicable, are displayed before the customer completes the order.


5. Orders and Contract Formation

After placing an order, the customer will normally receive an electronic acknowledgement or confirmation.

Receipt of an automated order acknowledgement does not necessarily mean that the order has been accepted.

We reserve the right to reject or cancel an order before acceptance for legitimate reasons, including:

  • A product being unavailable;

  • An obvious pricing or product information error;

  • Suspected fraud or unauthorized payment;

  • Delivery restrictions;

  • Legal or regulatory restrictions; or

  • Technical errors affecting the order.

If we cancel an order after payment has been received, the amount paid for the cancelled order will be refunded.

Once an order has been accepted by us, a binding purchase agreement is formed.


6. Payment

Customers may use the payment methods displayed during checkout.

Payment must be successfully authorized before an order can be processed.

The customer represents that they are authorized to use the selected payment method.

If a payment is rejected, reversed, cancelled, or suspected of being fraudulent, we may suspend or cancel the relevant order.


7. Shipping and Delivery

Available shipping methods, estimated delivery times, and shipping charges are displayed on our website or during checkout.

We aim to process and ship orders within the stated timeframes.

Delivery dates and transit times are estimates unless expressly guaranteed.

We are not responsible for delays caused by circumstances reasonably outside our control, such as carrier disruptions, customs processing, extreme weather, natural disasters, strikes, governmental actions, or other force majeure events.

This does not limit any mandatory rights available to consumers.

United States

For orders shipped to customers in the United States, we will comply with applicable requirements concerning advertised shipping times, delays, cancellations, and refunds.

If we cannot ship an order within the period promised to the customer, we will provide any notice, cancellation option, or refund required by applicable law.


8. EU/EEA Right of Withdrawal

This section applies to consumers in the European Union and European Economic Area where the statutory right of withdrawal applies.

8.1 30-Day Withdrawal Period

In addition to the minimum rights provided by applicable consumer law, Cieco Eyewear provides eligible consumers with a 30-day withdrawal period.

The withdrawal period starts on the day the customer, or a person designated by the customer other than the carrier, receives the product.

The customer may withdraw from the purchase within this 30-day period without providing a reason.

To exercise the right of withdrawal, the customer must clearly inform us of the decision to withdraw by contacting:

The customer may use any clear statement communicating the decision to withdraw.

8.2 Returning Products After Withdrawal

After notifying us of the withdrawal, the customer must return the product without undue delay.

As an additional contractual benefit beyond the statutory minimum, we allow the customer up to 30 days after notifying us of the withdrawal to send the product back.

Customers are responsible for direct return shipping costs unless:

  • We have expressly agreed to pay those costs;

  • The product is defective;

  • The wrong product was delivered; or

  • Applicable law requires us to bear those costs.

8.3 Refunds

Following a valid withdrawal, we will refund payments that are required to be refunded under applicable law.

For EU/EEA consumers, this includes the purchase price and, where required by law, the cost of the least expensive standard delivery option offered for the original order.

Refunds will be made without undue delay and no later than 14 days after we have been informed of the decision to withdraw.

We may, where permitted by law, withhold the refund until we have received the returned products or the customer has provided sufficient evidence that the products have been sent back, whichever occurs first.

Refunds will normally be made using the same payment method used for the original purchase unless otherwise agreed.

We may reduce the refund where permitted by law if the value of a product has been diminished because it was handled beyond what was reasonably necessary to establish its nature, characteristics, and functioning.


9. Exceptions to Withdrawal Rights

The right of withdrawal does not apply where an exception under applicable law applies.

This may include products:

  • Made specifically to the customer's specifications;

  • Clearly personalized for the customer; or

  • Otherwise excluded from withdrawal rights under mandatory applicable law.

Where an item is excluded from the right of withdrawal, this will be communicated where reasonably required before purchase.

The withdrawal exception does not remove any rights the customer may have if the product is defective, damaged, incorrectly supplied, or otherwise does not conform to the purchase agreement.


10. Returns for United States Customers

Unless a different return policy is clearly stated on the relevant product page or during checkout, customers in the United States may request a return within 30 days after receiving the product.

Eligible returned products should:

  • Be unused, except for reasonable inspection;

  • Be in substantially their original condition;

  • Include accessories and other items originally supplied with the product; and

  • Where reasonably possible, be returned with the original packaging.

Personalized or custom-made products are generally not eligible for change-of-mind returns unless we expressly agree otherwise.

This exclusion does not affect rights relating to defective, damaged, misdescribed, or incorrectly supplied products.

Unless required by law or otherwise stated by us, return shipping costs for change-of-mind returns are the customer's responsibility.

Original shipping fees are not refundable for voluntary U.S. returns unless required by applicable law or the return results from our error or a defective product.

Any rights available under applicable federal or state law remain unaffected.


11. Defective, Damaged or Incorrect Products

Customers should contact us as soon as reasonably possible if an order arrives damaged, defective, incomplete, or incorrect.

We may request reasonable information, photographs, or other evidence necessary to assess the issue.

Where a product does not comply with the purchase agreement, we will provide the remedy required under applicable law, which may include repair, replacement, price reduction, or refund depending on the circumstances and applicable legal requirements.

We will bear costs that applicable law requires us to bear in connection with a valid defective-product claim.


12. Legal Guarantee – European Consumers

Customers in the European Union and European Economic Area have mandatory legal rights relating to the conformity of goods.

These legal rights exist independently of any voluntary or commercial warranty offered by Cieco Eyewear or a manufacturer.

Where applicable, consumers may be entitled to remedies such as repair or replacement and, in appropriate circumstances, a price reduction or termination of the purchase agreement and refund.

Nothing in these Terms restricts the duration or scope of mandatory statutory conformity rights available under applicable national or European consumer law.

Unless expressly described as a “commercial guarantee” or “warranty”, statements in these Terms do not create a separate commercial guarantee beyond the rights provided by applicable law.


13. Warranty Rights – United States

For customers in the United States, products are subject to any express written warranty specifically provided with the product or displayed before purchase, together with any rights that cannot legally be excluded under applicable federal or state law.

Nothing in these Terms is intended to disclaim, restrict, or modify an implied warranty or other consumer right where doing so would be prohibited by applicable law.

If a separate written warranty applies to a product, the specific terms of that warranty will apply in addition to these Terms.


14. Limitation of Liability

To the fullest extent permitted by applicable law, Beyond The Brand will not be liable for indirect, incidental, special, or consequential losses that were not reasonably foreseeable when the purchase agreement was entered into.

For customers acting in the course of a business rather than as consumers, our aggregate liability arising from an order will, to the fullest extent permitted by law, be limited to the amount paid for the relevant order.

The above limitation does not apply where liability cannot legally be excluded or limited.

Nothing in these Terms excludes or limits liability for matters that cannot lawfully be excluded or limited, including where applicable:

  • Fraud or fraudulent misrepresentation;

  • Intentional misconduct;

  • Gross negligence where liability cannot legally be limited;

  • Death or personal injury caused by negligence where applicable law prohibits such limitation;

  • Liability arising under mandatory product liability laws; or

  • Mandatory statutory consumer rights.

For consumers, any limitation of liability in these Terms applies only to the extent permitted by the laws applicable to that consumer.


15. Customer Responsibilities

Customers are responsible for:

  • Providing accurate billing, delivery, and contact information;

  • Reviewing the order before submitting it;

  • Following reasonable product care and use instructions; and

  • Ensuring that purchasing, importing, possessing, or using the product is lawful in the destination country or state.

We are not responsible for delivery problems caused by materially incorrect information supplied by the customer, except where applicable law provides otherwise.


16. Promotions and Discount Codes

Promotions and discount codes may be subject to additional conditions communicated with the relevant promotion.

Unless stated otherwise:

  • Discount codes cannot be exchanged for cash;

  • Only one discount code may be used per order;

  • Discount codes may have an expiry date;

  • Discount codes may exclude certain products; and

  • Promotions may not be applied retroactively to completed purchases.

Nothing in promotional terms affects mandatory consumer rights.


17. Intellectual Property

All trademarks, trade names, logos, product designs, photographs, graphics, website content, and other intellectual property displayed through Cieco Eyewear remain the property of Beyond The Brand or the applicable rights holder.

Customers may not reproduce, distribute, commercially exploit, or otherwise use such material without prior permission, except where permitted by applicable law.


18. Privacy and Personal Data

We process personal information in accordance with our Privacy Policy and applicable privacy and data protection laws.

For customers in the European Union and European Economic Area, this includes applicable requirements under the General Data Protection Regulation (“GDPR”).

For customers in the United States, we will comply with applicable federal and state privacy laws to the extent those laws apply to our activities.

19. Complaints and Customer Service

Questions or complaints may be submitted to:

We aim to acknowledge and respond to complaints within a reasonable period and generally within 14 days.

If additional time is reasonably required to investigate a complaint, we will aim to inform the customer accordingly.

Nothing in this complaints procedure limits a customer's right to pursue remedies available under applicable law.


20. Force Majeure

We will not be responsible for a failure or delay in performing contractual obligations where that failure or delay results from events outside our reasonable control.

Such events may include natural disasters, extreme weather, war, terrorism, civil disturbance, government action, epidemics or pandemics, major transportation disruptions, strikes, utility failures, or substantial failures affecting communications or payment systems.

This provision does not limit any cancellation, refund, delivery, or other mandatory rights available to consumers.


21. Governing Law and Consumer Rights

These Terms and agreements with Beyond The Brand are generally governed by the laws of the Netherlands, without prejudice to mandatory consumer protection rules.

European Union and EEA Consumers

If you are a consumer residing in the European Union or European Economic Area, the choice of Dutch law does not deprive you of mandatory consumer protections provided by the laws that would otherwise apply to you.

Nothing in these Terms requires an EU/EEA consumer to bring a dispute exclusively before a Dutch court where applicable consumer law gives that consumer the right to bring proceedings elsewhere.

United States Consumers

For customers residing in the United States, Dutch law applies to the extent that such a choice of law is legally permitted.

Nothing in these Terms is intended to waive or restrict any mandatory consumer rights available under applicable U.S. federal or state law.

If a law applicable in a customer's U.S. state does not permit a provision of these Terms to apply, that provision will apply only to the maximum extent legally permitted.

Jurisdiction

Subject to mandatory consumer protection and jurisdiction rules, disputes relating to these Terms or purchases from Cieco Eyewear may be submitted to the competent courts of the Netherlands.

Nothing in this section prevents a consumer from using another court or dispute resolution procedure where applicable law gives the consumer a mandatory right to do so.


22. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where legally possible.

The remaining provisions will continue in effect.


23. Changes to These Terms

We may update these Terms from time to time, for example because of changes to our business, services, or applicable laws.

The Terms applicable to an order are normally the Terms in effect when that order is placed, unless applicable law requires otherwise.

The current version will be published on our website together with the date of the most recent update.
